1. Introduction
These Terms of Service govern the use of the Elufi mobile application (“the App”).
By downloading, accessing, or using the application, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the application.

Some features of the application require users to create an account. Users may create accounts using email and password, Apple login, Google login, or Facebook login.
Users are responsible for maintaining the confidentiality of their account credentials, and agree to notify us immediately if they believe their account has been compromised.
5. License to Use the Application
Elufi grants users a limited, non-exclusive, non-transferable, revocable license to download and use the application for personal, non-commercial purposes.
Users may not, except where permitted by applicable law:
- Copy the application
- Modify the application
- Distribute the application
- Sell or sublicense the application
- Reverse engineer the software
6. User Responsibilities
Users agree to use the application only for lawful purposes. Users must not:
- Attempt to hack, disrupt, or damage the application
- Interfere with servers or network infrastructure
- Use automated tools to exploit the application
- Use the application for illegal activities
- Impersonate other users or entities
Violation of these rules may result in suspension or termination of access.
7. Intellectual Property
All intellectual property rights related to the application, including but not limited to software, design, branding, content, graphics, and logos, are owned by the developer of Elufi or its licensors. These rights are protected by international copyright and intellectual property laws.

9. Local Data Storage
Most personal data generated within the application is stored locally on the user's device. This may include personal notes, wellness tracking data, meal history, and personal preferences. The application does not transmit this data to external servers unless required for a specific feature.
10. Subscriptions and Payments
Elufi may offer optional premium subscriptions. Payments are processed securely through the Apple App Store and Google Play Store. The application does not collect or store payment card information.
Subscriptions may automatically renew unless canceled by the user through the respective app store. Billing, renewals, and refund policies are governed by the Apple App Store or Google Play Store terms.
11. Advertising
The free version of the application may display advertisements. Advertisements may be provided by third-party services such as Google AdMob. Advertising providers may use device identifiers and similar technologies to deliver and measure advertisements. Users who purchase premium subscriptions may experience fewer or no advertisements depending on the subscription model.
12. Service Availability
The developer makes reasonable efforts to keep the application available and functional. However, the application may occasionally experience interruptions, maintenance periods, technical issues, or updates. The developer does not guarantee uninterrupted or error-free operation.
13. Account Termination
Users may delete their account at any time through the account deletion feature within the application, described on our Delete Account page. The developer may suspend or terminate access if users violate these Terms.
14. Limitation of Liability
The application is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, the developer shall not be liable for damages, data loss, financial loss, health outcomes, or service interruptions resulting from the use of the application. Users use the application at their own risk.
15. Indemnification
Users agree to indemnify and hold harmless the developer from any claims, damages, liabilities, or legal expenses arising from misuse of the application or violation of these Terms.
16. Dispute Resolution
If you have a concern or dispute, we encourage you to first contact us at support@elufi.app so we can try to resolve the issue informally. Most concerns can be resolved this way without the need for formal proceedings.
17. Governing Law
These Terms are governed by the laws of Poland. Any disputes related to the use of the application that cannot be resolved informally shall be subject to Polish jurisdiction, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the developer regarding the use of the application, and supersede any prior agreements on this subject.
20. Assignment
The developer may assign or transfer these Terms, in whole or in part, without restriction, for example in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without prior written consent.
21. Changes to the Service
The developer reserves the right to modify, update, or discontinue parts of the application at any time. Features may change or be removed without prior notice.
